The next step in the ILM Core programme for those who have completed the Beginners’ course or who may have come to the charity sector from a non-contentious probate background.

This two day course will provide an introduction to Contentious Probate led by Tony Cockayne and Barny Croft from Michelmores, together with a second day looking at charity specific areas of property, ex gratia payments and saving charitable gifts with Nichola Sims, and an introduction to Spanish Probate with Jonathan Eshkeri from E&G in Spain.

Speakers

Tony Cockayne, Michelmores

Tony is Head of the Charities Team at Michelmores.

Tony is an experienced dispute resolution lawyer who specialises in contentious probate matters.  He regularly advises on disputes involving charities, with his specialism being disputed legacies.

Over the years Tony has appeared in the High Court both for Claimants and Defendants in disputes involving large estates, often with cross-jurisdictional elements.

As a serving committee member of the Association of Contentious Trust and Probate Specialists, Tony is a leading figure for contentious private client work.  He is also an accredited mediator.

Barny Croft, Michelmores

Barny is a senior associate in the Disputed Wills and Trusts team. Having previously worked for Michelmores between 2008 and 2010, Barny re-joined the firm in 2014 from Stone King LLP and specialises in legacy related disputes for both charities and individuals.

Barny is experienced in dealing with disputed Wills on the grounds of lack of testamentary capacity, undue influence, lack of knowledge and approval, fraud and failure to execute a Will correctly; disputes concerning the provisions (or lack thereof) in Wills; proprietary estoppel claims (promises made during a testator’s lifetime, but not made good in their Wills); trust disputes; and claims concerning the administration of Estates, including professional negligence.

He is also a member of the Association of Contentious Trusts and Probate Specialists.

Jonathan Eshkeri, E&G Solicitors in Spain

Jonathan Eshkeri is a dual qualified solicitor and Spanish abogado, who has been practising Spanish law in Spain and England since 2004.  Jonathan is a founder partner of E & G Solicitors in Spain, with offices in London and in Tarragona, Spain.  Jonathan has taught law in London and Madrid at undergraduate and postgraduate levels and regularly speaks on the subject of Spanish succession law to legal practitioners and other professionals working in the field.

Jonathan acts for a number of English Registered Charities and individuals located around the world with regard to inheritance matters with a Spanish element.  Jonathan writes about Spanish succession law for various publications as well as being the Spanish correspondent for Private Client Adviser.

Nichola Sims

Nichola is the Training Manager for ILM, having worked in the charity sector since 1993, and in the legacy sector for most of those.  Having worked for The Salvation Army and Diabetes UK as well as freelance work at numerous national and local charities, she is especially keen to share best practice in legacy management, something which she believes can be seen and learnt from charities of all sizes and causes.
