An ex-gratia payment is an agreement to a payment being made from a sense of moral obligation rather than because of any legal requirement. 

What you will learn

  • when the concept of ex gratia payment originated; 
  • what an ex gratia payment is and when one can be made;  
  • the powers under section 106 of the Charities Act 2011;  
  • the procedure for applying for consent to make an ex-gratia payment; and 
  • the potential ex-gratia type scenarios that might arise. 

Completing the course

You must mark each section complete in order to successfully complete the course, but you can return to the sections at any point. At the end of the course you will complete a quiz, which can be retaken if you do not reach the pass mark of 80%. You will also be asked to submit a short written assignment. Upon successful completion of the quiz and assignment, you will receive your certificate!

She is an expert in litigation relating to charities, charity governance and charity legacies. She is a member of the Association of Contentious Trust and Probate Specialists (ACTAPS).

Sophie Cass, Bates Wells 

Sophie is an Associate in the Charity and Social Enterprise department at Bates Wells. She advises on specialist charity matters such as trusts and permanent endowment, charity legacies and faith-based issues. She is a member of the Society of Trust and Estate Practitioners (STEP).

Lucinda Ellen, Bates Wells
