In this online session, contentious probate specialist Claire Cox (Partner, Willans LLP) will take delegates behind the scenes of Ginger v Mickleburgh, a recent High Court will dispute involving allegations of testamentary incapacity and fraudulent calumny.
Drawing on her experience acting for the successful claimants, Claire will explain how the case was prepared from initial investigations through to a seven-day High Court trial, highlighting the evidence that ultimately proved decisive and what we can learn from this, including the practical realities of testing evidence in court.
The webinar will provide valuable insight into the factors that can increase litigation risk, and the lessons we can learn when faced with challenges to testamentary documents. Claire considers how the courts approach disputes involving mental capacity and what can make the difference between success and failure at trial.
