The session, delivered by Lucinda Ellen of Bates Wells LLP, will address how charities should best deal with concerns from executors in relation to potential personal liability, with practical tips on how to unlock legacies.

The session will be interactive and based on a case study. We will cover:

  • The relevant duties of an executor when administering an estate;
  • The common situations that may cause an executor to feel nervous about distributing the estate, including when dealing with claims under the Inheritance (Provision for Family and Dependants) Act 1975, and the problems this can cause;
  • Tools for facilitating the distribution of the estate where concerns have been raised, including the use of s.27 of the Trustees Act 1925; and
  • What you should and should not say to provide comfort to an executor.
